Description
The Green Lake County Board of Adjustment (BOA) is a quasi-judicial body that functions much like a court. Its primary role is to review and decide cases where there is an alleged error in a zoning department decision or where a relaxation of a zoning ordinance standard (i.e. variance), is sought. Secondarily, the Board is authorized by ordinance to issue special exception permits which are typically uses that are specifically listed in an ordinance that may only be permitted if the Board determines that the conditions specified in the ordinance for that use are satisfied. The Board also decides appeals as a result of decisions of the County Planning & Zoning Committee.
Through a public hearing process, applicants are able to present their case to the Board for review. While it is tempting to think of the Board as providing flexibility in the administration of zoning ordinances, flexibility is strictly limited by state and local laws that determine the Board’s authority and provide the criteria for decision-making. Appeals of BOA decisions are made to the Circuit Court where the evidence and decisions are reviewed. The BOA should be distinguished from the County Board and the Planning & Zoning Committee.
Structure
The Board of Adjustment consists of three (3) members and two (2) alternates. All members are appointed for three year staggered terms by the Green Lake County Board Chairman subject to approval by the County Board.
